FINAL ORDER/JUDGEMENT.

Samiran Dutta, Ld. President:-

Complt. is personally present. The case is fixed for exparte hearing. No steps is taken by the O.P who is found absent on repeated call.

The complt. case is that he along with his family member joined tour programme during 10.05.23 to 18.05.23 to Kashmir conducted by O.P / Tour operator on initial payment of Rs.2,06,000/- and further paid Rs.37,000/- as G.S.T on 08.05.23 as demanded by the O.P but no receipt has been furnished to the Complt. O.P took extra charges Rs.15,000/- for providing suitable car beyond package condition. The Complt. has approached the Commission for appropriate relief.

Perused the petition of the Complt. and all the documents on the record. Heard the Complt. Prima facie case is  established. The O.P has committed unfair trade practice within the meaning of Section 2(47)(vii) of Consumer Protection Act 2019 in not issuing receipt for services rendered by them. Receipt of G.S.T amount without having allotment of G.S.T.I.N is prohibited under law. The Complt. is entitled to get refund of Rs.37,000/- towards G.S.T payment together with litigation cost of  Rs.25,000/-.

Hence it is,

Ordered.

that the case be and the same is allowed exparte without. O.P / Tour operator is directed to pay to the Complt. Rs.37,000/- together with litigation cost Rs.25,000/- within a month of this date in default law will take its own course.

Let a plain copy of this order be given to the parties free of cost.
