JUDGEMENT

The  curx of the case is that  the above named complainant alleging deficiency in service  against  afore mentioned O.Ps for  non-restoration of service electrical connection bearing  consumer account No.313101040198 and account No.313101040195  for which  the complainant  sought for redressal of the grievances raised by the complainant.

 

            In the instant case the copy of the complaint was referred to the O.Ps   directing to given  written version of the case.  After service of notice the O.Ps have  failed to avail of the opportunity for filing  of the version of the case.  On number of dates the O.Ps have  failed  to appear  on the version dates fixed. As the version of the case was not filed by the O.Ps  within the time frame given in the C.P. Act, 1986, we have no alternative  but to resort to Section -13(2)(b)(ii) of the C.P. Act, 1986 and was set exparte to the O.Ps.

            During the course of exparte hearing the complainant is absent on repeated call.

            On perusal  of record it is found that the complainant is remaining absent since long  and not taking any step nor participating in the hearing of the case  for which the matter is lingering unnecessarily. As the complainant  is not taking any steps,  it is presumed that   the  complainant is not interested to proceed further with this case  and hence the complaint petition  is dismissed for default of the complainant and disposed  of accordingly.

 

            The Interim order  passed on Dt. 5.12.2016 stands vacated.

            Send copy of order to the parties.
