The complainant filed this case U/S.35 of the C.P Act 2019 for rendering deficiency in service by the Opposite Party (herein after called as Op) for which the complainant sought redressal from the O.P.
Brief facts of the case: -
The complainant is the resident of Karan Street Paralakhemundi having Electricity Connection bearing Con.No-312101170209 using electricity, supplied by the O.P. The Complainant received the electricity bill bearing No.3121112210000 48 M 8136 for an amount of Rs.26,973 for the month of December 2021 which is 10 times more than the regular bill. The complainant investigated the matter from her side and noticed the meter reading unit are wrong. The Complainant submits that she had paid Rs. 39,300/-vide receipt No.750433 on dtd.16.3.2021 and cleared till the month of March. The Complainant alleging such unfair of the O.P filed this case before this Commission.
Admitting the complaint after verified of jurisdiction and limitation, the Commission issued notice to the O.P. Accordingly, O.P appeared through his advocate and taken several adjournments stating one and same ground i.e “collection of documents” but not filed written version till the date of hearing.
On analysis of the complaint and evidence of affidavit and documents available on case record it is revealed that the complainant submitted a complaint on 03.01.2022 regarding high electricity consumption bill of Rs.26,973 for the month of December 2021,which was acknowledged by the O.P on 6.1.2022 but the O.P didn’t resolve the complaint and not rectified the bill within a stipulated period of one month as contemplated under Regulation 149-disputed erroneous bills of OERC distribution (Condition of supply) code-2019. Hence the complainant has proved her case that there is deficiency in service on the part of the O.Ps. Therefore, the O.P rendered below standard of performance and liable to pay compensation of Rs.50/- per each day of default from the date of receipt of complaint of the Complainant i.e 6.1.2022 in accordance to scheduled-III of the Regulations-2004.
O R D E R
Resultantly, the complaint is allowed. The O.P is directed and shall compensate of Rs.50 (Fifty) per each day of default in accordance to scheduled-III of the Regulations-2004 and issue revised bill dated 20.12.2021 together with directed to pay litigation cost of Rs.3,000 (Three Thousand rupees only). The entire order is to be compiled by the O.P within 45 days from the date of receipt of this order failing which in addition to the above order, the Op shall have to pay an amount of Rs.10,000 (Ten Thousand rupees only) in favour of Secretary Orphan Centre “Jagannath Niketan” located at R.Sitapur in addition to comply of the order passed in favour of the Complainant.
