Deficiency in energy service is the grievance of the complainant.

            The facts  relevant in the complaint petition are  that the complainant  is a domestic bonafied electric consumer under the O.Ps vide consumer No.JTT7799 and paying the monthly  electricity  dues regularly .The monthly dues is within Rs. 300/- but due to defective meter , the O.Ps. have imposed arbitrary electricity dues from April-14  to Dec-14 .Thereafter a new meter though has been installed by the O.Ps in the premises of the petitioner,  but the said meter is  running very fast. As a result the monthly electric bill issued by the O.Ps is more than  the consumption . Accordingly  the petitioner made several request to O.P.no. 2  verbally as well as with written request to  install  a check meter and revise  the arrear electricity dues . But the O.P.no. 2 did not pay any heed to it. Similarly  as per advice of O.P.no. 2 though the petitioner deposited Rs.200/ on dt. 21.5.16 for testing of meter but the O.P did not check the meter.  Thereafter the petitioner served a legal notice to O.P  on dt. 20.8.216 but the O.P  after receipt of the notice did not comply or reply to  the notice  which   clearly proves  the unfair trade practice and deficiency of service e on the part of the O.Ps .

            Accordingly finding no other alternative way  the petitioner has filed the present dispute with the prayer to direct the O.Ps to revise the arrear electricity  bill as per  law  along with pay compensation of Rs.20,000/ for deficiency  of service.

 The O.Ps   after appearance,   filed the  written version  stating  that :

1.The complain of the consumer has been resolved and revisionary effect has been given during    Oct-16

2.The revision statement and ledger copy attached herewith for information and necessary action of the Hon’ble Forum.

            On the date of hearing we heard the argument from the learned advocate  of the petitioner . perused the pleadings and documents available on record.

            After perusal of the record along with documents and ledger copy of the consumer filed from both the sides our observation is  as follows:-

1.It is cristal clear that the petitioner is a domestic consumer under the O.Ps and paying  the monthly electricity dues  regularly up to  Feb-2014.

2.It is also the  fact that when the  new meter was  installed the petitioner has alleged that the  new meter is running fast and subsequently the petitioner deposited  Rs.200/-on dt. 21.5.16 for testing  the meter and as well as has  served a  legal notice  to  the O.Ps.  regarding his grievance.

            Similarly  the O.Ps has   filed the  written version along  with ledger copy,  stating  that the arrear inflated electricity  bill  has already  been revised and reflected on the ledger copy from oct-2016 . The advocate  for the petitioner did not object to  it. Hence it is our considered view that  the O.P has  already solve the grievance of the petitioner on Oct-16  which is  much before the notice of the dispute was dispatched by this Fora.  Hence there is  no necessity  for passing any order in the present dispute .

O R D E R

            In the result the C.C. Case is dismissed.
