JUDGMENT.

  1. The Complainant being a beneficiary of the service provided by the O.P. has preferred this case

alleging deficiency in supply of electrical service. The case of the complainant is that, his electricity connection to his house for domestic use is in the name of his mother vides consumer No. 911125110136 and the complainant is using the same and paying the bill regularly. According to  the complainant, the monthly electricity bill as per meter reading was issued to him till August 2012 and thereafter the bill was issued  on an average basis and the units calculated for the same has been increased from 99 units to 360 units on different months without any reason as the meter is in a working condition. The further case of the complainant is that, the matter was reported by the complainant to the O.P. on 12.8.15,9.9.15 and on 4.12.15 but the O.P. did not take any action and on the other hand on 1.12.15 some person of the O.P. came to the residence of the complainant and tried to disconnect the electricity connection. Hence  the complaint.

 

2.            Although the O.P. appears in the case, he did not choose to file his written version and to proceed with the hearing of the case.

3.            Heard the complainant, perused the material available on record.

4.            In para-2 of the complaint petition the complainant has pleaded that, he was paying the electricity charges regularly till August 2012 as per meter reading  and from the next month he was charged with an average of 99 units per month till April 2013. The said average unit calculation has been increased from 99 to 109 units and then to 120 and then to 200 and lastly to 360 units without any basis. This pleading of the complainant is supported by an affidavit and documentary evidence.

5.            Perused the documentary evidence available on record. It is seen from the electricity bill filed by the complainant that, the bill has been issued on an average basis and the unit calculation has been increased in different months. There is no material available on record to show that on what basis the average has been calculated. There is also no evidence on record to show that the meter of the complainant is a defective one. It is also seen from the representation dt.12.8.2015 of the complainant that the matter has already been reported to the O.P. but no action has been taken. Therefore the case of the complainant is believed. Raising of irregular bill on an average basis by the O.P. without any reason  cannot be said to be fair, and the O.P. is under obligation to issue electricity bill as per consumption.

6.            The aforesaid act of the O.P. amounts to deficiency in service and due to the irregular act of the O.P. the complainant has sufficiently harassed by moving to the authority and also sustains financial loss. Hence the complainant is entitled to compensation.

                                                                                 ORDER:-

                 The O.P. is directed to revised the electricity bill of the complainant as per Meter reading  and to pay Rs. 50000/-(fifty thousands) to the complainant towards cost and compensation within one month from the date of receipt of this order.

             Accordingly the case is disposed of.
