Shri S. L. Behera, President :- The brief facts of the complaint case is that, the complainant is a consumer of the O.Ps. bearing Consumer No. 413001010695 and he was paying the electricity bills regularly to the O.Ps. The bills were between Ra.6,000/- only to Rs.7,000/- per month but in the month of April,2015 the complainant received an enhanced bill of Rs.21,023/- only similarly in the month of May and June,20125 he received bill of Rs.37,850/- only and Rs.62,694/- only respectively. The complainant reported the O.Ps. in writing on dtd. 07.07.2015 for investigation and correction of the bills and on dtd. 08.07.2015 the complainant requested in writing about his defected meter but the O.ps. did not take any action, hence this case.
On service of notice, the O.Ps. appeared and filed Written Version through his counsel admitting the facts of electricity connection and submitted that the complainant is having electrical connection of 3KW load capacity but the complainant has extended the consumption of electricity energy up to 11KW . The meter was burnt due to unauthorized high load of consumption. A new meter bearing No. WSC5097 installed on dtd. 12.09.2015 and the provisional bill of August,2015 is also re-verified and same is found of actual billing as recorded in the new meter installed on 12.09.2015 and bill for the consumption of earlier 12 days of meter installation has been proportionally calculated on the average of per day consumption from the last three months actual reading of replaced meter. The complainant even well aware of the facts as above and by taking benefit of this pending complainant is not paying monthly electricity bill and due to such non-payment, the arrear has increased of Rs.1,41,042.30P till November,2015 and to escape from his liability the complainant filed this case which is liable to be rejected.
Heard the matter in length from both the parties, gone through the case and materials available on record. The complainant is a consumer of O.P bearing consumer No. 413001010695. The complainant filed Xerox copies of several electricity bills and Money Receipts and letter send to O.Ps where the O.Ps filed Xerox copies of consumer reading sheet and statement of revision of bill. The O.Ps. rectified the bills after being revised for the alleged months of April,2015,May,2015 and June,2015. The alleged units for the above months were 10242 units in total i.e. 3414 units per month in average but it was revised as 1366 unit per month and after installation of new meter the actual meter reading was taken and the electricity bill was served accordingly. Due to non-payment of the above bills the arrear has increased to Rs.1,41,042/- only till November,2015.
The allegations of the complainant was rectified by the O.Ps. and further actual meter reading was taken and accordingly the electricity bills are being supplied by the O.ps. Hence as per the above observations the complainant petition is hereby partly allowed by directing the O.Ps to issue a fresh electricity bills to the complainant and the complainant is advised to pay the same accordingly.
Accordingly the case is disposed of.
Order pronounced in the open court today the 23rd day of August’ 2016 and copy of this order shall be supplied to the parties as per rule.
