Brief fact of this case is that, Complainant Kumudini Behera lodged her complaint to SDO Electrical,TPNODL against the excess bill on 23.10.21 and the SDO also assured her for necessary rectification.In the month of November2021, the Ops have issued the excess electric bill without any correction and the complainant intimated the fact to the SDO and requested him to issue correct bill after rectification. But SDO,TPONDL scolded her and threatened not to come furtherto his office and if she desires she may go to the Court for relief. Finding no other way the complainant paid the excess bill of Rs.11,914/- against Consumer No.621111040855 andreceived the money receipt on 15.11.22. But the Ops have issued another bill amounting to Rs.17,096/-against Consumer No.621111040874 in the same name on 11.11.22. It is clear that the Ops have issued two electric bills in one name against one meter. Further on 23.11.2022 the electrical field staff of the Ops and threatened the complainant to disconnect the electric line although the complainant has already paid the bill, for whichshe lost her reputation in the locality. Finding no alternate the complainant approached the Hon’ble Commission to issue direction to the Ops for necessary correction of the bill and omit the Consumer No.621111040874 from their record and sought for compensation for her mental agony, harassment and litigation expenses within a stipulated period.

Under the above complain the case was admitted and notice issued to Ops. All Ops appeared and filed their written version in detail. The complainant bearing consumer No.621111040855 availing power supply under Electrical Sub-Division, No.I, Keonjhar. Due to technical error accidentally issuing of duplicate/second bill of the complainant vide consumer No.621111040874 had been cancelled/stopped from the data base in the month of Feb.2023 after field verification. The allegations of ill behaviour to the complainant, harassment and negligence by Ops is baseless. The Ops humbly prayed the Commission to dismiss the case at the threshold and direct to the complainant to pay electric bill against the original Consumer No.621111040855.
On the above pleadings the following issues are framed to decide the case.
- Whether the case is maintainable?
- Whether any cause of action arises on this case?
- Whether Ops have made any deficiency of service?
- Whether the complainant is entitled to get any relief sought for?
FINDINGS
The complainant bearing consumer No.621111040855 of Ops has availed power supply to her house but for the same consumer the Ops issued another consumer No. 621111040874 in the same meter for which the complainant felt harassed and approached many times to Ops to rectify the 2nd bill of consumer No. 621111040874. But no result was found for which the complainant filed this case. After getting the notice of this Commission to show cause the case. Finally as per the written version submitted by Ops it is categorically admitted in para 2 that due to technical error, accidentally issued of duplicate/second bill of the complainant vide consumer No.621111040874 which had been cancelled/stopped from the data base in the month of February-2023 after field verification.
So far as the deficiency of service is concerned, the complainant is mentally harassed by the such acts of Ops for which Ops are liable to compensate the bonafide consumer. This case is maintainable.The complainant is liable to get the reliefs sought for.
ORDER.
The Ops are directed to pay compensation of Rs. 10,000/- to complainant within 45days of receipt of this order. On default it shall carry 9% interest per annum from the date of this order. The complainant is at liberty to realize the amount.
