As this matter is received on transfer from Mumbai Commission, Notices were issued by this commission on 9/7/13 to the appellant and Resp. on their address given in the appeal memo, but no report about service of notice is received. On perusal of the office copy of the notice it reflects that it was issued on the correct address as shown in the appeal memo as well as in complaint. Therefore it will have to be presumed that the Appellant and Respondent are served with notice. But none appeared for the appellant. Hence the appeal deserves to be dismissed. Accordingly, the appeal is dismissed in default.
