JUDGEMENT
The crux of the case is that the above named complainant alleging deficiency in service against afore mentioned O.Ps for non payment of EDLI amount and widow, children pension bearing EPF No.1683/1119 for which the complainant sought for redressal of the grievances raised by the complainant.
On being noticed the O.Ps filed written version before the District Commission through their learned counsels refuting the allegations made against them. The O.Ps prays the District Commission to dismiss the case against them for the best interest of justice.
Heard arguments from the learned counsels for the O.Ps and from the complainant. Perused the record, documents, written version filed by the parties.
This District Commission examined the entire material on record and given a thoughtful consideration to the arguments advanced before us by the parties touching the points both on the facts as well as on law.
FINDINGS.
Undisputedly the complainants father had worked as a Pump Driver since 12.12.1972 and expired on Dt.12.02.1998 while in service and also the complainants mother was also expired on Dt. 13.01.2020.. Undisputedly the complainants mother had already deposited excess amount of Rs.29,436/- paid towards CPF final withdrawal vide CPF account No. 1119/OLIC on Dt. 07.07.2017 through Union Bank of India, Vizag. Undisputedly the complainant is entitled of EDLI amount and childrens widow pension vide EPF Account No. OR/OR/1683/1119 from the O.Ps.
The O.P. No.1 &2 (OLIC) in their written version have contended that dur to non receipt of documents from the complainant the same are not submitted to the O.P. No.3 & 4 (EPF authority).
The O.Ps 3 & 4 (EPF authority) in their written version have contended that after receipt of the required documents from the O.P. No.1 & 2 (OLIC) the complainant will be eligible for the same.
The complainant during the course of hearing submitted that all the required documents have already submitted to the O.P. No.1 (OLIC) as required by the O.P. No.1 (copies of the same are available in the file)..
The District Commission observed as the complainant has already submitted all the required documents to the O.P. No.1(OLIC) so he should transmit the same to the O.P. No.2 (M.D., OLIC) . In turn the O.P. No.2 (M.D., OLIC) should transmit the same to the O.P. No.3( EPF authority ) to get the EDLI amount and childrens widow pension vide EPF Account No. OR/OR/1683/1119 by the complainant.
To meet the ends of justice the following order is passed.
ORDER.
The O.P. NO.1 & 2 (OLIC) are directed to transmit all the documents of the complainant to the E.P.F. authority within one month for sanction of EDLI amount and widow children pension bearing EPF No. 1683/1119 in favour of the complainant.
The O.P. No. 3 & 4 (E.P.F) authority are directed to sanction the EDLI amount and widow children pension bearing EPF A/c No. 1683/1119 and credit the sanction amount in the S.B. account of the complainant with in 3(three) months from the date of receipt of documents from the OLIC authority.
Parties are left to bear their own cost.
