Parties are absent on call. It reveals from the previous order that complainant is remaining absent on the date fixed for hearing .However, in view of Sec 38(3)(c) of C.P Act 2019 the case record taken up today to decide the complaint on merit.

We have given our thoughtful consideration to the respective contents of the parties .The complainant has prayed for  an order directing the O.P to release the family pension benefit along with interest therein and compensation with litigation cost.

The complainant has failed to prove by adducing cogent evidence that he is a consumer of either goods or service of the O.Ps as defined u/s 27 of the C.P Act 2019. Hence, we  are of our considered view that the present complaint is not maintainable under C.P Act . Hence, rejected . However, the complainant is at liberty to approach the proper court of law for redressal of his grievance. However,, no order as to cost. Case is disposed of accordingly.
