Dipti Kumar Mallick & Others filed a consumer case on 24 Aug 2022 against The Executive Engineer Electrical TPCODL& Others in the Jagatsinghapur Consumer Court. The case no is CC/69/2021 and the judgment uploaded on 05 Oct 2022.
JUDGMENT
Complainants have filed this consumer complaint U/s.35 of C.P. Act, 2019 seeking following reliefs;
“Direct the opposite parties to account for the rest of the outstanding amount of Rs.6,600/- with the consumer account number of Dillip Mallick and Deepak Mallick, S/o. Chandramani Mallick and provide new power supply through indemnity bond as per money receipt dtd.12.3.2021 by help of police assistance and to pay Rs.10,000/- towards compensation for deficiency of service and unfair trade practice, pay Rs.5,000/- towards cost of litigation”.
The brief fact of the case is that the complainants are both son and mother to each other and the invalid consumer account No.0400941(D) is also under the jurisdictions of the opposite parties. So they approached to give new power supply to their residential house although the opposite party No.3 has received the amount of Rs.3,300/- through E.S.T. No.20 dtd.12.3.2021 through M.R. No.042992 towards new service connection charges, but till date the opposite party No.3 is playing hide and seek relating to giving of the power supply. In the name of Chandramani Mallick, S/o. Gaji Mallick of village Krushnachandrapur, the new consolidation finally published R.O.R. bearing Khata No.47, Plot No.297 has been issued and thereafter the father of the complainant No.1 has got power supply vide consumer No.0400941 and the said line was disconnected, but the outstanding amount of Rs.9,900/- was stood against him. But despite non-clearance of the outstanding amount of Rs.9,900/- the opposite party No.3 unlawfully and violating the OERC Regulation has been allotted second service to his sons namely Deepak Kumar Mallick and Dillip Kumar Mallick. So at the time of allotment of second service connection the opposite party No.3 has not collected the requisite share from them. Now the father and his middle son along with his family members are staying separately over said plot by availing power supply but the complainant No.1 with his family members and complainant No.2 (mother) are staying another side of the said plot without electricity. The complainant No.1 requested to his father for getting new power supply, but his father totally refused to give NOC. So the complainant No.1 feel harassed due to refusal and wandering here and there for getting power supply. Lastly he filed a case in G.R.F. Paradeep for getting an order of power supply in C.C. Case No.GRF/PED/75/2021 and Hon’ble G.R.F., Paradeep directed the opposite party No.1 & A.M.C. Paradeep to provide new power supply within 15 days on the basis of execution of indemnity bond of the judgment dtd.05.02.2021. Despite receipt of the judgment, the opposite parties did not provide power supply to the complainant No.1 till yet.
On 29.10.2021 though it was ordered to give electric connection within 05 days and for non compliance of order dt.06.4.2021 complainant has also field E.A. No.12/2021 but the opposite parties have not responded to the notice of this Commission in the consumer complaint as well as in E.A. No.12/2021.
The opposite parties have received the amount of Rs.3,300/- through E.S.T. No.20 dt.12.3.2021 and through money receipt No.042992. The opposite parties have received the amount on 12.3.2021 and this Hon’ble Commission vide order dt.06.4.2021 directed for reconnection but the same has not been complied and the opposite parties have failed to provide electric connection which is basic need and should have been supplied immediately on receipt of order but in spite of notice of this Commission, the opposite parties have slept over the matter for which complainant has suffered a lot.
We therefore allow this complaint directing the opposite parties not to claim any outstanding, supply electricity, if the same has not been supplied to complainant and further direct to pay cost of Rs.2,000/- for mental agony and Rs.2,000/- towards cost of litigation. The opposite parties who were holding the post during the period of order dt.06.4.2021 and 29.10.2021 were passed are held responsible and he/they will pay the amount of Rs.4,000/- from his/their own pocket, so that in future the officer(s) will not dare to disregard the order of this Commission. With the aforesaid observation and direction the consumer complaint and E.A. No.12/2021 are hereby disposed of.
