                    Having heard the Ld. Counsel for the Complainant and Authorized representative of O.Ps and upon perusal of materials available on record it is noticed that the Complainant did prefer this Complainant seeking direction of this Forum to O.P-Company to go for reconnection of case line of the Consumer vide No. NB 26257 which has been disconnected by the O.Ps due to disturbance of the neighbor and to relinquish the bill amounts served on the Complainant during disconnection period i.e. from 11.10.2013 till yet which resulted adverse impact on the business of the Complainant putting him financial loss to the tune of Rs.97,643/-. The defence made out by the O.P-Company in their Written version is that the case premises inspected by O.Ps on 17.05.14 and found that bare conductor LT Line which has been extended through the Land of the Co-villager viz: Bhagirathi Prusty to the Land of Complainant, disconnected by said Bhagirathi Prusty forcefully due to illegal construction of one dwelling house under the bare LT Conductor. Previously it was beyond their knowledge and for the same O.P-Company issued bills on load factor basis regularly though no Power supply was there to case premises since last 8 months from 17.05.14, the date of inspection.

                    On the facts and in the circumstances of this case the Energy bills submitted to Complainant the son of deceased Consumer on the Load factor basis since 11.10.2013 till yet considered to be illegal and without any justification which needs to be waive out by the O.P-Company. Since it being not the willful/intentional on the part of O.P-Company no cost & compensation needs to be imposed on the O.P-Company. Accordingly, the complaint bears merit with following orders.

                    Having all regards to our aforesaid findings the complaint is allowed in part and accordingly the O.P-Company is directed to waive out all the bills imposed on the Complainant-Consumer against the case line on average basis since October 2013 onwards till reconnection provided to case line and to provide reconnection to case L.I Point through alternative possible way upon supply of required service wires by the Complainant.

                    Order compliance needs to be done within one month from the date of communication of this order.

                    In the circumstances of the case no order as to costs & compensation.
