The petitioner Md. Mozirul Patgiri is present. The O.P. is absent without any steps. The case is taken on exparte.

The petitioner Md. Mozirul Patgiri has submitted his evidence on affidavit. The complainant proved that he deposited the required security money to extent of Rs. 3,708/- vide Receipt No.883947 on 20/11/2003 to the O.P.s, yet the O.P.s did not provide electrical connection to the shop of the complainant till date in spite of his request for several times.

Since the O.P. failed to provide electrical connection to the shop of the complainant even after receipt of the aforesaid security money, as such, it is clear that the complainant has proved his case. Accordingly, the complainant is entitled to get back the security money of Rs. 3,708/- which was received by the O.P. on 20/11/2003 vide Receipt No.883947 with 6% interest on that amount till the date of final payment of the aforesaid amount since the date of receipt of the aforesaid amount by the O.P. i.e. 20/11/2003.

Accordingly, the case is disposed of exparte with cost.
