                                                             JUDGMENT

1.                     The facts of the complaint  in brief is that,  the complainant  has sent a Computer CPU and Monitor through the O.p 2  in a good condition and  when the courier  was received at the recipient address the goods is totally damaged  due to mishandling of the courier company. The complainant approached the O.p company but they lingered the matter and not responded  and hence finding no other option the complainant took shelter of the Hon’ble Forum and  prayed   to direct the O.ps  s to pay the cost of the said parcel Rs.38,800/-  with additional compensation of  Rs.2500/-  for mental agony and  award cost of litigation and such other relief  as the forum deem fit and proper. Hence, this complaint.

2.                     On being noticed,  the O.ps appeared through their advocate Sri N.K.Patra but failed to  file  written version as such they were set exparte and  in absence of any written version from the opposite party we proceeded  the matter exparte and  believed  the allegations of the complainant  and  hence, we passed the order and  dispose of the matter with the following directions.

 

 

                                                                  ORDER

                        The  opposite parties  are     directed to  pay the cost of the computer  i.e. Rs.38,800/-and pay  compensation of Rs.1000/-  for mental agony undergone by the complainant and cost of Rs.500/-  within one month from the date of receipt of this order, failing which the O.Ps are liable to pay  interest  @  12%  p.a. on the above awarded amount till  the date of payment.

                        Pronounced in open forum today on this 16^th   day of July,2015 under the seal and signature of this forum.

                         A copy of this order be forwarded to the parties    free of charge as per the statutory requirement.
