            This case is posted today for further hearing from the sides of complainant. Neither the complainant nor his advocate found present on repeated calls and also not filed any steps to adjourn the case. On perusal of case record it reveals that the complainant as well as his advocate are found absent since 07.06.2016to 16.2.2017. But on 14.3.2017 the advocate for complainant filed a petition for time. The advocate for O.Ps objected vehemently to grant time and prays to hear on that day. Time petition filed by the complainant was rejected and posted to 10.4.2017 for further hearing from the side of complainant. Today also the complainant as well his advocate are found absent. The advocate for O.Ps is present today.

            The complainant failed to perform his obligatory duty to remain present at the time of hearing as required under Rule 4 Sub Rule 8 of the Odisha Consumer Protection Rules, 1987.

            In the result we dismissed the complaint for default of appearance.

            The order is pronounced in the open Forum today on 10^th April 2017 under the signature and seal of this Forum. The office is directed to supply copy of order to the parties free of costs and a copy be sent to the server
