Today is fixed for filing show cause by the complainant.   

Ld. Advocate for the complainant files hazira. The complainant without filing show cause files a petition for an adjournment for ex parte hearing. But none came to move the said petition on repeated calls.

On perusal of the record, it is found that the case is long pending for ex parte hearing and as the complainant did not adduce evidence-on-affidavit, he was directed to file show cause as to why the case shall not be dismissed for non-prosecution. But the complainant has filed petition for adjournment for ex parte hearing which is misconceived one and has no leg to stand upon. Accordingly, the prayer for adjournment is hereby rejected. As the complainant did not file any show cause the case should be dismissed for non-prosecution.

Hence, it is

                                                   Ordered

that this case be and same is dismissed for non-prosecution.
