2.     It was contended that as per the clause in insurance policy if the insured during continuance of the policy got insurance coverage against similar insurance policy with one or more insurers, the maximum liability of the insurance company irrespective of number of such policies would be limited to the maximum sum insured.

1)                                       Whether the appellant is entitled to claim the amount of Rs.3 lakh under two different insurance policies issued by the respondent no.1 insurance company through different institutions?

If the insured shall at any time during the continuance of the policy be insured against the similar insurance policy with one or more insurers than the maximum liability of the insurer irrespective of the number of such policies in force with one or more insurers shall be limited to a maximum sum insured.
