This Complaint coming up before us for hearing on 16-06-11 in the presence of Sri G. Punna Reddy, advocate for the complainant and of Sri G. Srinivas, advocate for opposite party upon perusing the material on record after hearing both sides and having stood over till this day for consideration this Forum made the following:-
DOCKET ORDER
Per Sri A. Hazarath Rao, President:-
Exs.A-1 to A-8 on behalf of the complainant and Exs.B-1 to B-5 on behalf of opposite party were marked.
2. Heard. Perused the complaint and the version.
3. The complainant filed this complaint questioning Ex.A2 repudiation letter dated 07-11-08 addressed by the opposite party to him. During the course of further arguments the complainant on today i.e., 16-06-2011 filed memo as follows:
“It is submitted that in the above matter the opposite party contending that the complainant has not submitted claim form and concerned documents to them. Hence the Hon’ble Court may direct the opposite party receive the claim form and other documents of the complainant and to consider the claim as per the documents and pass such necessary orders”.
4. The said memo was brought to the notice of the counsel for the opposite party he endorsed “as seen”.
5. Under those circumstances rendering a decision on merits did not arise. In view of the said memo allowing the complaint with the following directions will meet the ends of justice as the Consumer Protection Act being a beneficial legislation.
6. In the result, the complaint is allowed directing the complainant to submit claim form with relevant documents to the opposite party under proper acknowledgement within a month; the opposite party is directed to process the claim within two months after receipt of claim forms with relevant documents from the complainant. No costs.
