ORDER ON ADMISSION

Mr. RAVISHANKAR, JUDICIAL MEMBER

1.        Heard counsel for appellant on admission.  The learned counsel for appellant submits that the complainant had filed a complaint against the Opposite Party alleging deficiency in service.  But in the year 2021, there was a pandemic lockdown for six months and the complainant was not able to appear before the District Commission to lead his evidence for which on 28.09.2021 the District Commission dismissed the complaint.  The appellant further submits that they have a good case to urge their claim, hence, prays to set aside the order passed by the District Commission.

2.        Considering the pandemic situation of the last year and considering the facts of the case, the Order passed by the District Commission is hereby set aside.  Hence, the following;

ORDER

The appeal is allowed on payment of costs of Rs.5,000/- which is payable to Consumer Welfare Fund. 

The District Commission is directed to the restore the matter in its original number and to provide an opportunity to the appellant/complainant to lead his evidence and to dispose-off the case on merits in accordance with law expeditiously.
