Both the parties are absent without step. The case was posted for today for passing necessary order. On perusal of order sheets and going through the C/R it is seen that the instant case was registered as C.C. No.29/09 on 23.07.2009. After completion of trial the case was fixed for judgement on 05.07.2011. But due to reasons shown in the orders the pronouncement of judgement was delayed. Thereafter, from 04.10.2012 the complainant has been continuously remaining absent before the Commission till today except 17.09.2013, on which date his conducting lawyer filed his attendance. This Commission, considering long non-appearance and prevailing Covid Pandemic situation at that time, was pleased to intimate the complainant vide notice of appearance dated 17.08.2020 and 05.01.2021 the next date fixed for his case. But inspite of sending notices the complainant has failed to appear before the Commission till this date. Considering all these, this Commission on 30.06.2023 passed an order to inform the conducting advocate for the complainant if he has not withdrawn his vakalatnama, to appear before the Commission and to represent the complainant on the day of delivery of judgement next date fixed. But no information has been received.

Under the above facts and circumstances we believe that the complainant is not interested with further proceeding of this case. Hence, considering the long pendency of this complaint, we feel it and proper to drop the case from proceeding.
