Today is fixed for compliance of the order under execution by the Jdr. On call the ld. Advocate for the Dhr. is present but none appears from the side of the Jdr. It appears from the record that on 30.7.2015 in compliance with the direction as mentioned in the final order of C.C. Case under execution, the Jdr. submitted a bankers’ cheque being No.133009 dated 24.7.2015 drawn on Bank of India for Rs.5,08,812/- in the name of M/s. IT Bazar, the firm of the Dhr. We carefully perused the final order passed in the C.C. Case and the bankers’ cheque as mentioned above. Being asked the Dhr. has submitted before this Forum that he is satisfied with the amount as mentioned in the cheque. The Dhr. is identified by his Ld. Advocate. From the side of the Dhr. a verified petition along with his Driving License and Adhar Card with copies has been filed. The original
Adhar Card and Driving License are verified with the copies. The original Adhar Card and the Driving License are returned to the Dhr. keeping the copies of the same on record. Considering the statement of the Dhr. and the documents submitted we are satisfied that the final order under execution has been fully satisfied on payment of the amount as mentioned in the bankers’ cheque. The Dhr. himself is present before this Forum. By filing the above petition the Dhr. has prayed to hand over the bankers’ cheque as mentioned above to him for encashment.
In view of the above discussions there is no bar to hand over the bankers’ cheque as mentioned above to the Dhr. and there is nothing to continue this execution case further. Hence, it is
Ordered
that the execution case is disposed of on full satisfaction. Let the bankers’ cheque being No.133009 dated 24.7.2015 for Rs.5,08,812/- drawn on Bank of India in the name of M/s. IT Bazar be handed over to the Dhr. on proper receipt. Let the copies of this order be supplied to the parties free of cost.
