Heard Ms. U. Das, learned counsel, appearing for the petitioner in the application for condonation of delay. None appears for the respondent despite service of notice. On 11-6-2013, the Commission has already recorded that service upon the respondent had already been completed but none appeared for the respondent.

                     This is an application for condonation of delay of 394 days in preferring the connected appeal. The explanation given in para 2 and 3 are supported by medical/treatment certificates issued by various dotors which are available from page 9 to 36 of the application for condonation of delay. We are satisfied with the explanation given in the condonation application. Accordingly, the delay of 394 is hereby condoned and Misc Case stands disposed of.

                      In view of the order passed in the Misc Case, Registry shall allot a number to the pending appeal and the same shall be listed on 16-8-2013 for admission.
