          The instant complaint u/S 25 & 27 of C.P.Act, 1986 has been filed by one Rabindranath Saha, Decree Holder herein against The Divisional Manager, National Insurance Co. Ltd, Berhampore Divisional Office (Judgment Debtor herein) for execution of an order dated 09.07.2015 passed by this Forum directing the Jdr to pay the claim amount a sum of Rs.60, 000/- with interest @ 9% pa. from the date of filing of this case to the complainant within two months from the date of this order failing which the OP No.1 have to pay Rs.50/- per day’s delay and the same is to be deposited in the Consumer Legal Aid Account.

       It appears from the case record that on 11.01.17, the Jdr has filed one cheque bearing No. 030297 dt. 06.01.17 of Rs. 75992/-drawn on Axis Bank Ltd., Berhampore Branch in favour of the Dhr. Jdr also filed another cheque bearing No. 030298 dt. 06.01.17 of Rs. 27100/-drawn on Axis Bank Ltd., Berhampore Branch in favour Legal Aid Account as fine for delayed payment.

The D.hr has received a sum of Rs.75992/- today and states that he has no further claim.

We find that the D.hr has received his awarded amount in full and we find that the Jdr has made payment of the awarded amount in full alongwith fine in compliance with the order of this Forum. So, we have no other alternative but to dispose of this Execution Application with full satisfaction.

Ordered

that the Execution Application No. EA/42/2015 be and the same is disposed of with full satisfaction.

 Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post  to the concerned parties as per rules, for information and necessary action.
