Final Order / Judgement

Order No. 2             Dt. 05/09/2022

Ld. Advocate for the complainant is present.

The case is taken up for admission hearing.

Perused the complaint along with copies of the document filed by the complainant.

Considered. Heard Ld. Advocate for the complainant.

The complainant has mentioned in Paragraph No.10 of complaint that he send notice dated 29.07.2021 to the Manager of Heritage Health Insurance TPA Private Ltd. for releasing the rest amount of Rs.47,995/- only. Photocopy of the said letter has been annexed as Annexure-B.

We found Annexure-B notice dated 29.07.2021 ia a unsigned copy.  No document has been filed by the complainant showing service of the notice upon the Manager of Heritage Health Insurance TPA Private Ltd.  It further appears that the settle amount of claim has not been denied by the complainant by sending any letter to the opposite parties.

The complainant by sending letters to the opposite parties only requested to disclose the proper bifurcation of amount of claim.  We do not find any prima facie document from which it can be ascertain that there is any cause of action to file the case against the opposite parties.

Therefore, the case does not warrant to be admitted.

Thus the instant case stands dismissed.
