               Perused the written version filed by the Opp.Parties. It is submitted by the Opp.Parties that the complainant on earlier occasion has filed a consumer case before the Dist. Forum, Rayagada vide C.C. No.07 of 2011  with regard to the Policy No.692834856   and 572345013 and the said case was already decided on 06.09.2011.We perused the  copy of order filed by the Opp.Party vide C.C. No.07 of 2011    wherein the  Consumer Forum has  directed the complainant  to submit the proposal form for the claim along with all the filled up application through the OP 2  and on receipt of such claim forms the OP 1 will dispose of the matter as per the spirit of the policy and without defeating the very purpose of the same within a reasonable time.  As the matter has already been disposed of vide C.C.No,.07 of 2011, it is not necessary to file another case for the same purpose. The complainant is to carry on as per  the direction of the Forum  and if the Opp.Party  disobey the direction of the Forum then  the complainant can file  case U/s 25 & 27 of the C.P.Act. Hence, the complaint petition filed by the complainant is dismissed .

             Pronounced in open forum today on this 21st  day of  October, 2016 under the seal and signature of this forum.

             A copy of this order as per the statutory requirements, be forwarded to the parties    free of charge
