JUDGMENT

                The  present dispute arises out of the complaint petition filed by the above named complainant alleging deficiency in service  against  afore mentioned O.Ps for allow  the complainant   to run the Industry there or else to pay the claim amount of Rs. 19 lakhs with interest.

            The O.P. appeared  and filed  reply.

             Before hearing  of the  C.C. case the learned counsel for the complainant filed  copy of the  order of  hon’ble High Court vide case No. W.P© No. 21320/  2015 Dtd. 3.12.2015 which is marked as Annexure-I.

            Perused the  order of the Hon’ble  High Court. On perusal of the High Court order we observed when the case is sub-judice before the Hon’ble High Court on the same cause of action this forum has lack of jurisdiction  to continue the same before this forum. 

            Hence the case is dismissed accordingly. Parties are left to bear their own cost.
