Heard the learned counsel for the appellant. 

1.         The matter could be disposed of at the stage of admission in view of the fact that the complaint was dismissed even before registering at the SR stage itself. 

2.         The case of the complainant is that when electricity connection was not provided, he filed OP.No.145/1995 and the same was dismissed.  Aggrieved by the said order, the complainant preferred appeal, FA.No.522/2001.  The State Commission allowed the said appeal on 24.05.2004 directing the Electricity Board to give electrical connection.  Despite the orders, they did not provide the electricity connection.  On that E.A. Proceedings were initiated and for two years they dragged on the matter and gave connection finally.  Due to the delay, he sustained a loss to a tune of Rs.9    The District Forum dismissed the complaint holding that it was barred by  

3.         We do not see how the matter could be held to be   Equally, the District Forum ought to have seen that the complaint could not have filed for recovery of compensation on the ground of deficiency of service in delaying giving service connection.  The earlier case was for direction to issue agricultural connection to the complainant.  The present claim is on off-shoot of it.  Both are unrelated. We set aside the order of the District Forum. In the circumstances, we direct the District Forum to register the complaint and proceed according to law.

4.         The appeal is allowed accordingly.  No costs.
