This case record has been placed before the ld. Judges of Upobhokta Lok Adalat for settlement.

Both sides are found present.

According to the submission of the J/dr. they have already complied the award and deposit Rs. 28,000/- by way of depositing account payee cheque being no. 123847 of Kotak Mahindra Bank, Rashbehari Avenue Branch, Kolkata and the said cheque has been kept under the safe custody of Register, DCDRC, Hooghly.

It is the point of contention of the D/hr. for waiving remaining portion of the direction which is given in the judgement for payment of Rs. 50 per day after the expiry of 45 days from the date of award.

As per submission of ld. Advocate for the J/dr. that for the fault of the ld. Advocate the said amount has been imposed by this District Forum and so it would be huge burden for him to pay the said amount.

So the J/dr. has prayed for waiving the said amount.

After considering the submission of both sides and also after perusing the materials of this case record the Members of the Upobhokta Lok Adalat are of the view that Rs. 5000/- can be deposited in the fund of Consumer Legal Aid Account of DCDRC, Hooghly.

So, the J/dr. is directed to deposit Rs. 5000/- by way of bank draft in the fund of Consumer Legal Aid Account of DCDRC, Hooghly within 21.12.2022.

In the light of the observation made above this execution case is disposed of.

Let a true copy of this order be handed over to both sides at free of cost.
