ORDER IN ADMISSION MATTER

                           This appeal is directed against the order dated 09.06.2016 passed by the District Forum, Chapra in Complaint case No. 20 of 2016 by which the complaint has been dismissed.

2.                                   Briefly, stated the case of the complainant-appellant is that his Ration Card was burnt when house was burnt a few years back but he has not been provided Ration Card by the opposite party-Respondent hence, he filed a complaint before the District Forum, Chapra. The Opposite party-Respondent contested the case. The Forum passed the order dismissed the complaint against which this appeal is preferred.

3.                   The appellant is present in Person. Heard and perused the District Forum order. The case is not maintainable under section 2 (I) d (ii) of Consumer Protection Act, 1986. The opposite party- Respondent District supply officer Chapra is not a service provider and the complainant-appellant is not a consumer of Respondent District supply officer and has not paid a consideration money to provide any services. The Complainant / Appellant had to approach the competent authority for a new Ration Card. If not issued then he should have to approach the District Magistrate but he has wrongly approached the Consumer Forum which is not maintainable. Hence, the appeal is dismissed at the admission stage itself.
