Final Order / Judgement

            This is a complaint made by one Nagarmal Agarwal, S/o Late Banarsi Lal Agarwal of 22, Justice Dwarkanath Road, P.S.-Bhowanipore, Kolkata-20 against the District Engineer, South Regional Office 6, Mandevilla Gardens, Kolkata-700 019 praying for a direction upon the O.P. to  restore the electric line of the petitioner in the scheduled property.

            Facts in brief are that Complainant Nagarmal Agarwal is a tenant in respect of one shop room situated at 22, Justice Dwarkanath Road, P.S.-Bhowanipore, Kolkata-700 020. The tenant of the said shop room enjoyed electricity being No.2432799M and  also Meter No.2163875K and Consumer No.19011144006. Complainant paid electric bills month by month. But, unfortunately, OP disconnected the electric meter. Complainant regularly requested the OP to restore the electric line. But, unfortunately, failed and neglected to do so. Complainant being a bona fide consumer suffered great loss and injury in his business. Complainant having no other alternative sent Advocate’s notice to the OP hand to hand. So, Complainant filed this case.

            OP No filed written objection and denied the allegations of the complaint.

            Further, OP has stated that the Consumer No.19011144006 stands in the name of Nabadip Lal Shah and so the question of restoration of electric connection does not arise. In addition, OP has stated about some regulations of the electric supply and prayed for dismissal of this case.

Decision with reasons

         Complainant filed affidavit-in-chief wherein he has reiterated the facts mentioned in the complaint petition. OP has also filed affidavit-in-chief wherein OP has reiterated the facts of written version. Complainant filed questionnaire against the evidence of the OP and thereafter argument was heard.

Main point for determination is whether Complainant is entitled to the reliefs as prayed for.

            On perusal of the complaint petition, it appears that Complainant has prayed for restoring electric connection.

            In this regard, Complainant has filed Xerox copy of the electric bill which shows that Consumer No.1901114406 stands in the name of Nabadip Lal Saha and not in the name of the Complainant. Accordingly, the question of restoration of electricity of this consumer No. in the name of Nagarmal Agarwal does not arise. So, it appears that there is no ground to allow the prayer of the Complainant.

            Hence,

ordered

            CC/13/2017 and the same is dismissed on contest.
