Order No. 1.
Date : 30-12-2011.
The case is taken up for admission hearing.
The complainant a resident of 5/2, Dr. Abani Dutta Road, P.S. Golabari, Howrah, had come up with this application U/S 12 of the C .P. Act, 1986 with a prayer for relief to pay Rs. 50,000/- towards compensation and damages from the O.P., District Engineer, CESC Ltd., Howrah Regional Office, together with the prayer for interim order restraining the CESC Ltd. from disconnecting the electric connection from the suit meter and for other reliefs.
Seen the petition of complaint. Heard the ld. Lawyer. Considered.
After going through the recital of the petition we are constrained to hold that the instant case is an amateurish attempt in the garb of an apparently innocuous story of apprehension for disconnection of his meter in case the complainant does not pay Rs. 75,000/- assessed in a separate bill of one Bikash Choraria. In absence of any concrete threatening letter from the O.P. CESC Authority that their men are blackmailing the complainant and exerting pressure upon the complainant for realization of Rs. 75,000/-, we are unable to entertain this meritless petition of complaint. Inasmuch as the complainant has failed to produce any cogent document over the existence of any fictitious bill in the name of one Bikash Choraria, we are of the opinion that the complainant has made an attempt to hoodwink the Court in procuring a favourable order only to bully the CESC Authority to whom a huge amount of electricity bill are lying due ( e.g. bill for Oct’11 Rs. 11,390/- and for Nov’11 Rs. 5,070/- are still lying outstanding ).
We trace no deficiency of service on the part of the service provider CESC Authority. Furthermore the apprehension of disconnection by the complainant is just a myth as because non payment of huge amount of bill would have justified disconnection earlier.
Hence,
O R D E R E D
That the petition is rejected.
