        Complainant Mohan Nayak was an independent contesting candidate in the general election to Lok Sabha in the year 2009.  His grievance  is that the Dist. Election Officer / Dist. Collector, the opposite party herein has denied the copy of the Electoral roll that has to be supplied to a contesting candidate free of cost.  Hence the complaint claming compensation .

        Opposite party, the Dist.Collector filed version.  According to  the Dist. Collector under rule  85 D  of the Conduct of Election Rules of Election Commission , the Election Commission of India has directed them  to provide one copy of the electoral roll on free of cost to the candidate of every recognized political  parties.  Since the complainant was not  belonged to any  recognized political party, he was not supplied the electoral roll free of cost and as per existing norms of Election  Commission there is no provision to sanction any compensation.  However the maintainability of the complaint is not disputed by the opposite party

   Complainant heard.

       The relevant extract of the rule of Election Commission of India is produced by the opposite party.  It shows that only a contesting candidate  of a recognized political party  is entitled for a free copy of the electoral roll.

    This being the situation we do not find any deficiency in service on the part of the opposite party .  Hence the complaint fails and accordingly  dismissed without any order as to  cost. d
