The petitioner is present. This date was fixed for hearing the case on the point of admission.
Heard the ld. counsel who submitted before this Forum that the petitioner filed this case against the distributor ‘Puspa Gas Service’, Modern Market, C.T.C. Bus Stand, P.S. Amta, Howrah, on the ground that he booked for a gas cylinder on 26.02.2015 over phone bearing booking no. 308908 and on 13.03.2015 when he enquired about the gas then he was asked by the o.p. to deposit documents like Aadhar Card and bank account number and he did the same even though the mandatory provision of depositing the documents started from 1st April, 2015. The gas was supplied to him on 24.3.2015 which caused harassment to him being handicapped and senior citizen and so he filed this case for the physical and mental sufferings and prayed for compensation of Rs. 1 lakh.
In support of his case the petitioner filed one legal notice, voter identity card and handicapped certificate. He has not deposited the booking slip which was delivered to him at the time of delivery of gas cylinder i.e., on 24.3.2015 and actually there was a gap of 28 days in supplying the gas since booking and no other cause of action like non delivery of gas and non receiving complaint etc. The grounds shown by the petitioner are found frivolous in the absence of booking slip or payment receipt to prove his case prima facie. It is true that the petitioner is a consumer but this Forum finds no dispute between him and o.p. in the absence of relevant documents to accept this petition as a consumer case.
In view of above, the case is not admitted and hence it is rejected.
