The complaint case is that the application filed by the complainant          Smt. Sandhya Koley under Section 12 of the Consumer Protection Act, is taken for admission. The case has been filed against Director, Managing Director of Dishari Health Centre Chandannagar and other doctors. The allegation against doctor as embodied in the complaint can be reproduced in short that this complainant is a helpless widow. Her husband was Gopal Koley. Her husband was admitted at Dishari Health Service Unit, under Chandannagar Corporation on 11.01.2006. The respiratory distress of Gopal Koley was found at 9.20 p.m. and patient died on 11.01.06 at 10.15 p.m. The allegation is that there was negligence on the part of the OP. No document has been filed particularly admission register or any connecting paper or any bill. Now it is the case that has been filed on 21.05.18. It is after 12 years later. The clear law permits 2 years from the date of cause of action.

            Accordingly, the case is not admitted because it is time barred.

            Hence, the CC Case being no. 64/2018 is not admitted and stands dismissed due to aforesaid reason.
