                                        J u d g e m e n t.

        The  present disputes arises out of the complaint petition filed by the above named complainant alleging deficiency in service  against  afore mentioned O.Ps for non issuence of original certificate of Final  B.Tech (Civil)  and mark sheet.  The brief facts of the case  has summarised here under.

          That the complainant joined as student of O.P.No.1  for the course  of B.Tech in Civl Engineering  vide enrollment No. DE-II/08/176572 and Roll No. 202452 and admission was made by the O.P. No.1  during the year 2009.   As per the instruction of the O.P. No.1  the complainant  deposited all the fees for entire course of Eight semesters and also  completed  his education of Final B-Tech degree.. The amount has been deposited    with the O.P. No.1 regular interval  before starting of the year. The complainant also completed   the B.Tech degree from  the O.P. No.1 & 2 as a regular candidate.. After completion of education he received  his marksheet  for Ist., 2nd., 3rd. vth., vith,.  during the year 2014.  But till date he has not  received the certificates  of marksheet of IVth, VIIth.,and VIIIth. Semester.   Inspite of repeated approach with the O.Ps from time to time the O.Ps are not heard the grievance of the complainant. Hence this case. The complainant prays the forum direct the O.Ps for immediately supply the copies of the Final  B.Tech  original,  mark sheet and   certificate  in addition to compensation and  other relief as the hon’ble forum deems fit and proper in the best interest of justice.

          On being noticed the O.Ps are absent on repeated call despite in lieu of received notice from the  forum as  revealed from the postal acknowledgement.. The O.Ps neither entering in to appear before the forum nor filed their  written version though availing  of more than  05 adjournments. Complainant consequently filed his memo and prayed to set exparte of the O.Ps.  Observing lapses of around one year  for which the objectives  of the legislature of the C.P. Act going to be destroyed to the prejudice of the interest of the complainant.  Hence after hearing from  the   complainant set the case  exparte against the O.Ps. The action of the O.Ps is against the principles of  natural justice as envisaged  under section  13(2) (b)(ii) of the Act. Hence the O.P. set exparte  as the statutory period  for filing of  written version was over to close the case with in the time frame permitted by the C.P. Act.                                                        Findings.

          We therefore proceed to dispose of the case, on its merit. We perused the complaint petition and the accompanied  document filed by the complainant

          During the exparte  hearing the complainant examined himself and  filed  Xerox copies  of memorandum of marks of B.Tech in Civil Engineering (First Semester) Examination, July, 2009, Second Semester Examination, July, 2009, 3rd. semester Examination January, 2010, 5th. Semester Examination June, 2011,  6th. Semester January, 2012 which are marked as  Annexure –I to  Annexure-5. The complainant  proved  that he  was studied at O.P. No.1’s institution  and the O.P. No.2 was issued certificate in favour of the complainant. The complainant also argued  due to non issuence of  the  original  certificates by the O.Ps  as thus  he suffered a lot of mental agony. Therefore  the complainant prays the forum as the  O.Ps  paid deaf ear  to  any  grievance of the complainant till date   so the  O.Ps  be  directed   to  issue   the   original certificate of qualifying examination of the complainant.

In   absence  of   written  version  from the side  of the O.Ps. it is  presumed that the allegations  levelled against   the  O.Ps. deemed  to have  been  proved.    The  complainant   had  paid  fees     for the good service  as per  assurance  which  intended      with the O.P and the  said payment is  made for the consideration for the said   service.  When the O.Ps  have failed to  give such service  as per assurance   for   which  the O.Ps  have   received   the  amount.   It is  deemed that the  O.Ps   were   callous to the allegations  and it amounts  to deficiency  of service. In this regard there have been catena of decisions of Hon’ble National Commission and Hon’ble Apex Court we relai.

It is held and reported  in  C.P.R- 2010(2) page No.426  where in  the Hon’ble  State   Commission, Andhra  Pradesh  observed  “Where complainant joined M.Sc  course  and appeared in  examination  conducted   by  the  University, the latter would  be obliged  to issue original  certificate  to the complainant.”

It is held and reported  in C.P.R. 2006(2) page No. 314 the Hon’ble  State Commission, Chhatisgarh  where in observed “ Education-Delay  in issuance  of mark sheet-University  is responsible for non fulfilment of their obligations to furnish mark sheets to the complainant”.  In the present case  non  issuance of certificates  by the O.Ps forced the complainant   to sit idle and preventing  him from being an employee and lost opportunity  to  get any job  or employment  due to the callousness  and negligence of the O.Ps. Hence, he faced monetary loss on account of unemployment.

In our view  the action of the O.Ps.  prior to duty bound  should  have corrigendum  its  crocodile  process  to settle  the dispute of the student  and consequently  should take  war footing   steps  to settle the  matter by issuing the original  certificate  in favour of the complainant.

Because of  deliberate in action  on the part of the O.Ps  in the present case the O.Ps have not come with  clean hands and  not  doing good to the complaint   which  is found only  to be  avoid the legitmate right as claimed by the  complainant as such the plea of the O.Ps can not be  accepted.  Since the complainant is hopefull of getting  original certificate in the door steps and denial of such legitmate right  is a deficiency of service putting the complainant in to financial trouble and to drag him in to legal complications.  Hence in order to avoid the same and to save the complainant from the present plight the O.Ps are advised  to issue original certificate in favour of the complainant in the spirit of legislation  intent.  Further  for failure to act properly by the O.Ps  the complainant should not be  deprived of their  legitmate entitlement.  It is   ensured  that the  benefits to which the complainant is eligible and entitled to enjoy  it and it should not became   a distant dream  so as to have peaceful  living.

Further we observed the O.Ps are not rendering proper service to the complainant establishes their callousness and whimsical attitude. The  forum feel that the services of the O.Ps  are deteriorating and does not follows   ethics.  Due to the negligent attitude of  the  O.Ps complainant deprived of   getting   job in these hard days.

In view of the above discussion relating to the above case and  In Res-IPSA-Loquiture  as well as  in the light of the settled legal position  discussed  as above referring citations  there  exists a strong deficiency in service on the part of the  O.Ps which is Aliance Juris. Hence  we allow the above complaint petition  in part.

Hence to meet the ends of justice, the following order is passed.

                                                                ORDER.

In Resultant the complaint petition is allowed in part on Exparte  against the O.Ps.

The  O.Ps  are hereby  ordered to issue  final  original B.Tech.(Civil) certificate along  with mark list and   provisional  in favour of the complainant immediately  inter alia  to pay Rs.5,000/- towards damages for mental agony  and litigation expenses to the complainant.

The O.Ps  are  ordered to comply the above directions within  45 days from the date of receipt of this order. Serve the copies of the above  order  to the parties concerned immediately free of charges.
