JUDGMENT /FINAL ORDER
Complainant above named filed this complaint against the aforesaid Opposite Parties praying for direction to make payment of Rs. 2,25,022/-, compensation amounting to Rs. 1,00,000/-, cost of the case amounting to Rs. 50,000/- and other reliefs.
He alleged that he deposited Rs. 1,70,000/- before the O.Ps and they issued three certificates amounting to Rs. 70,000/-, 50,000/- and 50,000/- respectively vide no. 906007, 902942 & 897385 and maturity dates of the aforesaid three fixed deposits were 16/02/2022, 26/01/2022 and 09/02/2022 respectively and maturity amount were Rs. 92,656/-, 66,183 and 66,183 respectively.
Complainant was in expectation that he would get Rs. 2,25,022/- after the date of maturity Opposite Parties not yet paid the said amount in his favour. Hence, he filed this case.
Decisions with Reasons:-
Case was admitted on 09/04/2024. Thereafter 15/05/2024 was fixed for filing requisites by the Complainant in respect of petition U/s 69(2) of C.P. Act, 2019 but on that date Complainant was absent without any steps.
Complainant was asked to file Show Cause by 04/06/2024 as to why necessary order shall not be passed against him vide order no. 04 dated 15/05/2024.

But on the next date i.e. on 04/06/2024 and 12/08/2024 Complainant did not take any steps nor filed Show Cause as per order no. 04 dated 15/05/2024.
Complainant did not produce original documents in support of his case so this Commission is unable to decide this case on merit.
The conduct of the Complainant indicates that he is not willing to proceed with this case. In this situation we have no other alternative but to dismiss the case.
In the result, present case fails.

That the present case be and the same vide no. CC/101/2024 is dismissed ex-parte against the Opposite Parties but without any order as to costs.
Let a copy of this order be supplied to both the parties free of cost as per CPR, 2005.
