This application for review which is numbered as RA/02/2022 relates to the Judgment passed in CC/64/2020.
By filing this aforesaid application the applicants have pointed out that the names of the substituted legal heirs of the original complainant of CC 64/2020 were not noted in the cause title of the Judgment passed therein on 08.03.2022. Since Judgment passed in CC 64/2020 with exparte, so we do not think it necessary to issue notices to the persons against whom the Judgment was directed.
On being asked the Bench Clerk puts up the case record of CC 64/2020 which was disposed of on 08.03.2022. A cursory perusal of this record reveals that during pendency of CC 64/2020, the Complainant passed away, and his legal heirs were substituted. But neither in the cause title, nor in the body of the Judgment, the said fact was entered into. This happened due to inadvertance.
In exercise of Power conferred under Section 40 of the new C.P Act, 2019, we intend to get the Judgment corrected.
The Judgment in CC 64/2020 is therefore corrected accordingly and kept with the record of CC/64/2020.
A copy of this Judgment is given to the petition free of cost. Another copy be kept with the record of CC/64/2020.
Hence the Review Application is thus disposed of.
