J u d g e m e n t.
The present disputes arises out of the complaint petition filed by the above named complainant alleging deficiency in service against afore mentioned O.Ps for non correction of actual date of birth in the original X th. Class certificate inter alia non receipt of original certificates.
Upon Notice, the O.Ps authorised agent Sri Jagadish Chandra Sahoo, appeared in person before the forum and submitted that he has already handed over the corrected original marks statement and Migration-cum-transfer certificate to the complainant. Regarding the original pass certificate, the O.P. submitted that NIOs Hqrs., Noida has already dispatched the same to NIOs, Regional centre, Bhubaneswar on 7th. September,2018 vide speed post consignment No.ED7248309951 IN. The document is on transit and expected to be received by 11th. September, 2018 and will be delivered to the complainant immediately.
Heard arguments from the O.P and from the complainant. Perused the record, documents, written version filed by the parties.
This forum examined the entire material on record and given a thoughtful consideration to the arguments advanced before us by the parties touching the points both on the facts as well as on law.
FINDINGS.
From the records it reveals that, there is no dispute that the complainant has received Marks statement of Secondary School Examination, and Migration-Cum-transfer certificate from the O.P. on Dt. 20.8.2018 (copies of same are in the file marked as Annexure-I & II). Further it is revealed regarding the original pass certificate, NIOs Hqrs., Noida has already dispatched the same to NIOs, Regional centre, Bhubaneswar on 7th. September, 2018 vide speed post consignment No.ED7248309951 IN (copies of the original pass certificate and postal internet statement is in the file which is marked as Annexure-3 & 4).
This forum observed the O.P after receipt of notice from the Forum promptly have delivered the Marks statement of Secondary School Examination, and Migration-Cum-transfer certificate to the complainant and there is no deficiency in service on the part of the O.Ps. The present case in hand the complainant is not entitled any compensation from the O.P.
To meet the ends of justice the following order is passed.
ORDER.
Accordingly the case stands disposed off.
The O.P. is directed to deliver the original pass certificate to the complainant within 15 days from the date of receipt of this order. There is no order as to cost and compensation.
