Today it is fixed for admission hearing of the Complaint Case. This Petition of complaint has been filed by one Mrs. Nandita Chakraborty who claimed herself to be a consumer and she further claimed that her claim has to be dealt with under the provisions of the Consumer Protection Act. Hd. Ld. Counsel for the complainant who with all fairness admitted that the O.P. undertook to, provide the flat & covered garage but  intentionally caused delay to enter into an agreement for sale  though the averments of the petition of complaint reveals that in any case it would not be before December 2020 (page 11). Hence, we are not going to admit the petition of complaint rather, we reject the same in terms of Section 13(3) of the Act, the cause of action of the same being a  premature one.
