ORDER

As per office note, report qua notice sent to respondent No.2 through ordinary post on 04.07.2017 has not yet been received.

It is coming out from the record that the complaint filed by the appellants/complainants was dismissed in limini.

We have heard the appellants in person, Counsel for respondent No.1 and perused the record.

We feel that there were arguable points, upon which, it was necessary to give opportunity to the appellants/complainants, to lead evidence, after calling the Opposite Parties to answer the questions raised by the appellants/complainants. However, it was not done and in a cursory manner, finding was given against them.

After hearing both the parties,   we are of the view that the matter be remitted to the concerned Forum to decide it a-fresh on merits.  Ordered accordingly.

Both the parties are directed to put in appearance before the concerned Forum on 30.08.2017.

File of the Forum be sent back immediately, so as to reach there well before the date fixed.

Certified copies of this order be sent to the parties, free of charge.
