Today is fixed for filing evidence on affidavit by the complainant.

Complainant by filing a petition supported by affidavit is praying before this District Commission for withdrawing this case without any liberty for filing the same on the self same cause of action. Copy of this petition served upon the ld. Advocate for the op.

Heard both sides. Considered submission. Perused the petition which has been filed by the complainant. Ld. Advocate for the op is not raising any objection in the matter of withdrawing this case.

After going through the materials of the case record and on close examination of the petition filed today by the complainant it appears that the complainant is voluntarily withdrawing this case without any liberty to file the same afresh.

In view of this position the Members of this District Commission finds that there is no bar for granting permission to the complainant for withdrawing this case.

In the result, it is accordingly

Ordered

that this complaint case be and the same is disposed of as it is withdrawn without any liberty to file the same on the self same cause of action.

No order is passed as to costs.
