Today is fixed for hearing of MA/217/2022.

The Ld. Advocates on both sides are present. They advanced submissions on the aforesaid application. The Ld. Advocate appearing for the OP frankly submits that her clients do not have any objection to the application being no. MA/217/2022 for amendment of the complaint. It is submitted by the Ld. Advocate of the complainant that for changing the cause title to bring ‘The Secretary, Calcutta Heart Clinic and Hospital’ into this record after deleting the name of the said ‘The Director, Calcutta Heart Clinic and Hospital’ and for that the present application is filed. We find that the nature and character will not be changed if such amendment is allowed.

As such, prayer for amendment is allowed and MA/217/2022 is thus disposed of.

Amended complaint incorporating the name of ‘The Secretary, Calcutta Heart Clinic and Hospital’ is filed with copy to the Ld. Advocate of the OP.

Evidence on affidavit is filed by the Ld. Advocate of the complainant with copy to the Ld. Advocate of the OP.

It is submitted by the Ld. Advocate of the OPs that copies of the documents which was filed along with the complaint have not so far been supplied to her and perusal of those documents are necessary for preparation of questionnaire. As such, the Ld. Advocate of the complainant is directed to copies of those documents to OP within 15 days hence either by sending post or otherwise.

As such, 10.02.2023 is fixed for filing questionnaire by the OP.
