Case of the complainant in brief is as follows:-
The complainant invested Rs.5,50,000/- under MIS Scheme with the opposite parties on 30/12/2015 for three years with a monthly interest of Rs.1100/-. It is further stated by the complainant that he further invested Rs.2,83,250/- towards Fix Deposit Scheme with the o.p. – alchemist on 15/03/2016 for the period of 30 months. It is stated in the petition of complainant that the opt. – Alchemist did not pay the monthly interest of the invested amount of Rs.5,50,000/- to the complainant for which on several occasions he visited the office of the o.ps and requested them to disburse the said amount in favour of him. After the maturity of total invested amount of Rs.8,33,250/- the complainant requested the opt. to disburse the same in his favour but opt. did nothing to that effect. The complainant sent Advocate’s letter dated 30/01/2019 to the opt. requesting the same but opt. did not turn up for which the complainant filed this case praying for direction upon the o.ps to disburse the invested amount of Rs.5,50,000/- and 2,83,250/- along with compensation and litigation cost.
Notice was served upon the opt. no.1. Notices were also served upon the opt. nos. 2 and 3 through paper publication. In spite of service of notice none appears on behalf of the o.ps. Hence the case was fixed for ex parte against all the o.ps vide Order No.5 dated 04/07/2019.
Decision with reasons :
The complainant filed some certificates to prove that he invested Rs.5,50,000/- and Rs.2,83,250/- with the opt. It appears from the document on record that the said amount was matured on 30/12/2018 and 15/09/2018. The letter dated 30/01/2019 supports the contention of the complainant that he requested the opt. to disburse the invested amount in his favour. Therefore, fromthe unchallenged evidence of the complainant, we are of opinion that the complainant has fully corroborated with the case and is entitled to the reliefs.
Hence, it is,
Ordered
that the CC/82/2019 is allowed ex parte against o.ps with cost. O.ps are directed to pay Rs.8,33,250/- (Rupees Eight Lakh Thirty Three Thousand Two Hundred and Fifty) only to the complainant within one month from this date of order. O.ps are further directed to pay Rs.50,000/- (Rupees Fifty Thousand) only towards compensation and Rs.10,000/- (Rupees Ten Thousand) only towards litigation cost of the complainant within 30 days from the date of communication of this order, i.d. an interest @ 8% p.a. shall accrue over the entire sum due to the credit of the complainant till full realization.
