The case of the complainant is as follows:

            The complainant invested Rs.3,00,000 (Rupees Three Lakhs) only under the Real Estate Scheme of o.p. – Alchemist Township India Ltd. for four years eleven months and after expiry of said period the maturity value of said amount would be Rs.6,00,000/- (Rupees Six Lakhs) only. Accordingly, o.p. issued a Certificate No. TA05452090 in favour of the complainant. it is stated that after the maturity of the invested amount on 30/07/2018 the complainant requested the o.p. to disburse the matured amount of Rs.6,00,000/- in his favour by a letter dated 21/08/2018 but till date o.p. did not turn up. After waiting for a  considerable time the complainant filed this case praying for the direction upon the o.p. to disburse Rs.6,00,000/- along with the harassment cost of Rs.50,000/-.

            Notice has been served upon the o.p. no.1 in spite of service of notice none appears on behalf of o.p. no.1. Hence the case was proceeded ex parte against him vide Order No.4 dated 05/03/2019. In spite of service of notice through paper publication none appears on behalf of o.p. no.2.

            Hence the case was fixed ex parte against o.p. no.2.

Decision with reasons

            The complainant invested Rs.3,00,000/- under the Real Estate Scheme / Project of o.ps. which after expiry of four years eleven months i.e. on 30/07/2018 would not be less than Rs.6,00,000/-. It appears from the money receipt filed by the complainant that the o.p. received Rs.3,00,000/- from the complainant on 28/01/2013. Subsequently complainant filed the certificate issued by the o.p. to substantiate his claim. Further it appears from the letter dated 21/08/2018 that the complainant requested the o.p. to disburse the maturity amount of Rs.6,00,000/- in his favour. Therefore, from the unchallenged evidence of the complainant, we are of opinion that the complainant has fully corroborated with his case and is entitled to get the reliefs.

            Hence, it is,

                           Ordered

            That the CC/343/2018 is allowed ex parte against the o.ps. with cost. O.ps. are directed to disburse of Rs.6,00,000 (Rupees Six Lakhs) only along with the compensation and harassment cost of Rs.20,000/- (Rupees Twenty Thousand) only and litigation cost of Rs. 5000/- (Rupees five thousand) only to the complainant within 30 days from the date of communication of this order, i.d. an interest @ 8% p.a. shall accrue over the entire sum due to the credit of the complainant till full realization.
