Ld. Advocate for the Judgement/debtor submits that this case is not maintainable before the present Commission in view of the order passed by the National Company Law Tribunal, New Delhi..

Heard both sides.

In view of order dated 23.08.2022 passed by the National Company Law Tribunal, New Delhi, Principal Bench in Company Petition (IB)-635 (PB) 2021 and order dated 08.07.2022 passed in IA-3054/2022 and Public Announcement dated 06.04.2022 in Form ‘A’ under Regulations 6 of the Insolvency and Bankruptcy Board of India (Insolvency Resolution Process for Corporate Persons) Regulations, 2016 issued by Mr. Gourav Misra (Interim Resolution Professional of Alchemist Infra Realty Limited) the case is not maintainable before this Commission as per provisions of Section 14(1)(a) of the Insolvency and Bankruptcy Code 2016.

This case is being prohibited as per provisions of Section 14(1)(a) of the Insolvency and Bankruptcy Code 2016, is hereby dropped.

Complainant is at liberty to withdraw the original documents, if any, from the record  on proper verification, identification and receipt from the Registrar, D.C.D.R.C., Kolkata, Unit-I.
