C.C.No.235 of 2021
Jarnail Singh Vs. Air Aspire & Another
Present: None for the complainant.
Fresh address of OPs No.1 & 2 not filed. Perusal of the file reveals that on 06.08.2021, the complainant was directed to furnish the fresh address of OPs within 15 days and case was adjourned to 22.10.2021. On 22.10.2021 the quorum is not complete and case is adjourned to 24.11.2021 for the same purpose. On 24.11.2021, fresh address was not filed and case was adjourned to 18.01.2022 for issuance of notice to Ops through dasti summons. In the meanwhile, on 06.12.2021, the summons issued through dasti by the complainant but the Ops did not collect dasti. On 18.01.2022, case is adjourned to 30.03.2022 for issuance of notice to the Ops. On 30.03.2022, notice issued to OPs through dasti received back with the report as “Office closed” and again the case is adjourned to 03.06.2022 with the direction to the complainant for furnishing the fresh address of OPs within 15 days. On 03.06.2022 & 04.08.2022, the fresh address of OPs was not furnished and case was adjourned to 04.08.2022 & 09.09.2022 respectively. On 09.09.2022, the fresh address of OPs was not furnished and case was adjourned to 17.10.2022 subject to last opportunity. Today, again despite the last opportunity, the fresh address of OPs has not been provided. No justification has been provided for non furnishing of the address of OPs. Also none has been appearing on behalf of the complainant since 03.06.2022 nor any intimation has been received from him seeking leave to appear before the Commission. In these circumstances, we are of the view that no useful purpose is being served by repeatedly adjourning the matter for the same purpose. In our opinion, it would be appropriate to adjourn the case Sine Die till the correct address of the OPs is provided by the complainant to the Commission, and we order accordingly. However, it is made clear that the complainant shall be at liberty to get the present complaint restored at its original number as and when he is able to provide the correct address of the OPs No.1 & 2.
