          The case is  taken up for admission hearing.

          Heard the complainant in person who submits that he is the holder of Smart Card of Metro Rail, Kolkata and on 07.06.2017 the OP deducted Rs.25/- from his Smart Card on the reason of coming back from Sovabazar Sutanuti Metro Rail Station area within 03 minutes from his entry. He further submits  that the matter was reported to the Metro Rail, Kolkata  as well as Hon’ble Minister-in-charge, Department of  Railways, New Delhi and  the Metro Rail vide letter dated 06.07.2017 explained the reason for deduction of Rs.25/ - in terms of  para 4.10 of Metro Railway Business Rule.

          We have heard the complainant in person and perused the compliant petition including its annexure thereto. Fact remains  that the complainant had entered the paid area of Sovabazar Metro Station on 07.06.2017 at 22.13 Hrs. to avail South bound train where the last train to South passes at 22.03 Hrs. In terms of para 4.10 of Metro Railway Business Rule, when a passenger holding a smart card or smart token or student smart card is allowed to exit from paid area of the said station at which entry has been punched. In such situation, token is collected at the gate and general smart card is deducted with Rs.25/- (Maximum chargeable fare) and one ride is deducted from smart card.

          Considering the facts and circumstances of the complaint coupled with para 4.10 of Metro Railway Business Rule, we are not inclined to admit the complaint. Accordingly, the complaint is liable to be dismissed. Hence

        ORDERED

          That the complaint is not admitted and dismissed in limine
