Today is fixed for S/R. No step is taken by the Complainant. The record shows that no step was taken by the Complainant on 19.04.22, 30.06.22, 22.09.22, 16.01.23, 02.05.23, 05.07.23 and today i.e. on 20.09.23. The case of the Complainant as per materials on record is that the Complainant purchased a scooty/scooter vide engine No. JF49EW2085926 Model Id Grazia Red colour from the OP on 26.12.19 at a sum of Rs. 63,013/-. The OP assured that the Complainant would get the registration certificate and insurance of the said scooty. So the Complainant has also paid Rs. 20,201/- to the OP. The OP does not take any initiative to register the said scooty to the local RTO. After showing various causes the OP send a letter dated 14.11.20 to the Complainant and to inform that ‘’ as per RTO information pending BS4 vehicles will start registration getting registered soon as per honorable Supreme Court dated 13th August, 2020’’. But the OP fails to register the said vehicle to the local RTO. The Complainant filed an application before the Assistant Director, Consumer Affairs & Fair Business Practice at Murshidabad state of WB. The OP submitted a written statement before the Consumer Affairs & Fair Business Practice at Murshidabad that the OP would register the said Scooty within May, 2021. But again the OP fails to register the said vehicle to the local RTO. So, without registration the said scooty is useless to the Complainant. We peruse the materials on record. In the instant case, the Complaint was admitted on 25.01.22 and notice was ordered to be issued upon the OP. S/R of notice was not received for long period. Such being the position, the Complainant was directed to take fresh steps for issuance of notice upon the OP. But the Complainant has not been taking steps. So, it is clear that the notice was not served upon the OP due to negligence on the part of the Complainant. Moreover, considering the facts and circumstances of the case we are of the view that the instant case has no merit as the Complainant is not at all interested in the instant case. In view of the matters discussed above we are of the view that the instant case is liable to be dismissed on merit. In the result, the Consumer case fails. Fees paid are correct. Hence, it is Ordered that the complaint Case No. CC/68/2021 be and the same is dismissed on merit against the OP. Let plain copy of this order be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand /by post under proper acknowledgment as per rules, for information and necessary action.
