                                                          J u d g e m e n t.

          The  present disputes arises out of the complaint petition filed by the above named complainant alleging deficiency in service  against  afore mentioned O.Ps for non Re-evaluating  &  re-addition of  ten marks in Mathematics  paper accurately  and to issuance of  the revised  mark sheet  in  +2 Examination for the year  2016 in  favour of the complainant. 

                This forum has consigned  notice  along with the copy of complaint  to the  O.P.  to   appear  in person before the forum on Dt.2.12.2016  along with  all the required  documents  in C.C. case No. 259 of 2016 for hearing.  Aggrieved to the above show  cause  letter  No. 903   Dt. 1.11.2016   the  O.P. preferred  W.P©  bearing No. 22477 of 2016  before the  hon’ble  High Court for quashing  the proceedings of  Consumer case No. 259 of 2016  pending before the  District Consumer forum, Rayagada against the O.P.   The O.P. appeared before the forum  through  their learned counsel and  submitted  the  copies of final  order Dt.23.12.2016 of  Hon’ble High Court  W.P© No. 22477 of 2016 before the forum and prays the forum to  dismiss the complaint petition  for the best interest  of justice.

                The  O.Ps advanced  their argument  cited  the decision of the Madras  High Court rendered in the case of A Deemed University represented by  its Registrar  Dr. Balchandran Vrs  The District Consumer Disputes Redressal Forum, Thanjav VR 613002 and others (W.P. (MD) Nos. 13993 / 12, 13994  to 13995 and 15058 of 2012.

                Heard from the parties. Perused the  record and referring the  Hon’ble  High court  order.

                                                                                FINDINGS.

                On perusal of  complaint petition we observed the complaint does not comes under the ambit  of Section 2(1)(d) of Consumer Protection Act, 1986   as she  is not a consumer and the O.P is no way  service provider who provides service for certain consideration. Further examinations fees are not consideration for providing service  to the students  in the shape of conducting examinations.   It is held on Dt. 17.09.1998  in First Appeal No. 804 of 1996  the hon’ble State  Commission, Odisha, Cuttack where in observed  that a candidate  who appears for the examination can not be  regarded as a person  who hired or availed of service of the University or Board for consideration.

                Further in Civil appeal No. 3911 of 2003   ”Bihar  School Examination Board Vrs. Suresh Prasad Sinha  where  in the  Hon’ble  Supreme  Court  on Dt.4.9.2009  observed  that the Board  is not a ‘Service provider’ and a student who takes an examination is not a ‘Consumer’ and further observed that  complaint under the C.P. Act. 1986   will not be maintainable  against the Board  before the forum.

We  are   not going to the merits of the matter and express   no opinion in respect  of the same for deciding the points raised by the complainant. It is open to the complainant to take resort to proper court  of   law  for  relief claimed by him.

            In the  resultant the complaint petition is dismissed but without cost.
