The petitioner has filed the present dispute alleging deficiency in service against the O.Ps.
The fact as per complaint petition in short is that the petitioner is serving as an officer of the Indian Air Force at Jammu and Kashmir . The petitioner contacted with the O.P.no.1 for sending some house hold items for his old parents from LEH, Jammu and Kashmir at Jajpur Town Orissa. The O.P.no.1 promised to provide proper service and safe delivery of the petitioner’s house hold item at the destination. According to the advice of O. P no.1 the petitioner boked his house hold items containing to 20 Kgs through O.P.no.1 bearing docket No.433542981 on 02.08.2016 from LEH,Jammu and Kashmir to Jajpur Town, Orissa and the petitioner paid Rs.1,611/- in cash for said services. Thereafter the petitioner himself reached in the office of O.P.no.4 on 08.09.2016 and enquired about his docket no.433542981. The staff of O.P.no.4 approached this petitioner to take docket no.433543001 but the petitioner refused to take the said docket no.433542001 as the said docket was not the petitioner’s docket( house hold items ) . The staff of O.p no.4 further assured the petitioner to provide the docket No.433542981 within a week . The petitioner met the O.P.no.4from time to time for his docket ,but the O.Ps are taking various plea in various time to avoid to settle the claim of the petitioner ,for which the petitioner has suffered both mental agony as well as financial loss . Thereafter the petitioner has also filed the complaint petition before the O.ps through online . The O.ps finally refused to settle the claim of the petitioner on 03.12.2016. Accordingly finding no other alternative the petitioner knocked the door of this commission with the prayer to direct the O.P to deliver the docket no.433542981 ( containing house hold items) of the petitioner immediately along with compensation to pay Rs.4,50,000/- towards deficiency in service as well as to pay Rs.30,000/- towards cost of house hold item docket no.433542981 and to provide Rs.19,000/- towards mental and physical agony and legal expenses .
After receipt of notices the present dispute ,the o.ps appeared but fails to file written version nor took any steps within the specific time fixed by this commission. Hence the O.P has been set exparte vide order dt.17.09.19 by this commission.
On the date of hearing we heard the argument on the learned advocate for the petitioner. That the O.Ps not appeared After perusal of the record and documents in details it is undisputed fact that the petitioner sent some house hold item through the O.Ps . The op received Rs 1611 /- as delivery charges. He promised to deliver within 6 days.
On the other hand the O.P after appearance did not file any objection or written version against the complaint of the petition . Hence there is no scope remained before this commission without accepting the uncontroverted statement made in the complaint petition as per observation of National commission stated below :
1.2013(1) –CPR-507-N.C
Wherein it is held that :-
“The written version is not filed after several opportunity , It is presumed that there is no defence on merit .
2003( CLT) –vol-96—315 ( C.D case no 37/02)
“In absence of written version the commission is bound to accept the uncontroverted statement of the complaint petition . “
Hence this order:
The dispute is allowed exparte. The O.P is directed to deliver the docket no.433542981 containing house hold item to the petitioner within 7 days after receipt of this order along with compensation of Rs10,000/- or value of the docket ( containing house hold item of Rs 30,000 plus delivery charges Rs 1611/ total Rs 41,611/- within one month after receipt of this order, failing which the petitioner can take steps as per law , in case of non compliance of order .
